Mr Hussain wins £4,250 payout after working as a Back Tender at Rainshore Mill, Rochdale caused him to lose some of his hearing.
This was a particularly difficult case as Mr Hussain had first been provided with a hearing aid in 1998. Normally a legal rule called limitation would apply and prevent him from claiming. Limitation is a legal rule that states that you must bring a personal injury claim within 3 years of when you knew or ought to have known that the injury you have suffered was caused by the Defendants. However Mr Hussain’s first language was not English so we solicitors argued that an exception should be made in his case. The Defendants decided not to take the risk of running the case to court and chose instead to settle.
