Ms J wins just over £3,000.00 payout for her noise induced hearing loss claim.
Ms J worked for Debenhams Ltd (Lotus) of Freeman Street, Stafford from 1972 to 1981. She was employed as a filler and worked in the heel department. He duties involved cementing heels on to shoes. Ms J was employed in a very noisy environment, with many machines surrounding her, including buffing, scouring and spraying machinery. She advises that if she wanted to communicate with someone a few feet away, she would have to shout.
During Ms J’s employment with this company, she was never provided with any hearing protection and never warned about the dangers of excessive noise exposure. She advises that the issue was simply never mentioned.
Ms J then began to suffer from hearing loss and wondered whether this was attributable to her previous employment, within such a noisy environment. Ms J contacted WE Solicitors and an audiogram and medical report were arranged, which confirmed that Ms J was suffering from noise induced hearing loss.
This was a particularly difficult case as this was not the only place where Ms J was exposed to excessive noise. Ms J also has an ongoing claim against Evode Ltd, also of Stafford.
WE Solicitors managed to agree a settlement of £3,087.70 in conclusion of her claim against Debenhams (Lotus). This was agreed on an out-of-court basis, avoiding the need for the case to go to trial.
